MEMBER'S RESPONSIBILITIES
1. Content. I will be solely responsible for the content or information that I publish or otherwise communicate through the Services to other members. I consent and license TRUE.com™ to use and disclose the content that I furnish in providing its Services.
2. Code of Ethics
I agree to adhere to the TRUE Code of Ethics and certify that:
- I have never been convicted of a felony. (This certification will be verified through TRUE's Criminal Screening)
- I am not married. (This certification will be verified for U.S. citizens through TRUE's Single Certification)
- I will be truthful in the information presented in my Personal Profile.
- I will maintain any photos posted to my Personal Profile to within 3 years of the date taken.
- I will truthfully answer the questions in the TRUE.compatibility Test™.
- I will not use any defamatory, abusive, obscene, profane, or otherwise offensive material on the TRUE website or in communications with other TRUE Members.
- I will treat all fellow members with dignity and respect.
- I will notify TRUE promptly of any Member's violation of this Code of Ethics.
3. Verification of Certifications
I hereby authorize TRUE to confirm my criminal background and/or marital status through the use of third-party data aggregators.
4. Use of Services.
a. I will use the Services in a manner consistent with any and all applicable local, state, national and international laws.
b. I will not provide inaccurate, misleading or false information to TRUE.com or to any other visitor or member.
c. I will not use the system provided to transport to any other user any obscene, profane, defamatory, offensive, threatening, harassing, or illegal materials that offend or violate any other party's rights.
d. I will not engage in any advertising or solicitation to buy or sell any products or services through the use of these Services.
e. I will not post, copy, transfer or show in any manner any copyrighted or trademarked or proprietary information without the prior consent of the owner of such proprietary rights.
f. I will only create one unique profile for the Services provided. I will not include any telephone numbers, street addresses, last names, URLs, or email addresses in any content, email, chat message or any other communication.
g. I acknowledge that TRUE.com provides free trial offers of various lengths such as 3, 7 and 10 days, that such offers are subject to additional terms and conditions, and that I will review the applicable terms and conditions before I select a trial offer. I acknowledge that True.com will charge my account following the expiration of my offer if I have not cancelled before the expiration.
TRUE RIGHTS
5. TRUE.com's Content Review. I agree and understand that TRUE.com may, but is not required to, review, edit and delete any content, email, messages, photos or profiles that, in TRUE's sole judgment, violates this Agreement or which may be offensive, illegal or that might violate the rights of other members. If I am using TRUE.com's services without cost (e.g., through a free trial or other form of free membership privileges), then I also agree that (a) I will not share an email address, instant message address or other similar address with TRUE.com members other than my True.com email address, and (b) TRUE.com has the right to remove any such address from my email or other communications and/or to substitute my TRUE.com email address in place of such adddress in my communications.
6. Proprietary Rights. I acknowledge TRUE.com owns and retains all proprietary rights in the Services and its Web site. The Web site contains the copyrighted material, trademarks, and other proprietary information of TRUE.com, and its licensors. I understand that I may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.
LIMITATIONS
7. Compatibility. I understand that TRUE.com makes no guarantees, either expressed or implied, regarding my ultimate compatibility with individuals I meet through these services.
8. LIMITATION ON LIABILITY. I UNDERSTAND THAT TRUE.COM WILL NOT BE LIABLE TO ME OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS ARISING FROM MY USE OF THE WEB SITE OR THE SERVICES. NOTWITHSTANDING ANYTHING TO THE CONTRARY, I UNDERSTAND TRUE.COM'S LIABILITY TO ME FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT I PAID TRUE.COM FOR THE SERVICES.
9. Disclaimers. I understand TRUE.com is not responsible for any incorrect or inaccurate information posted on the Web site or in connection with the Services. The Web site and the Services are provided "AS-IS" and TRUE.com expressly disclaims any warranty of fitness for a particular purpose or non-infringement. TRUE.com cannot guarantee and does not promise any specific results from use of the Web site and/or the Services.
10. User's Conduct. I understand TRUE.com is not responsible for the conduct, whether online or offline, of any user of the Web site or of the Services.
11. Lack of Responsibility. I acknowledge that TRUE.com assumes no responsibility for any error or delay in transmission, line failure, theft or destruction or unauthorized access to my communications. TRUE.com is not responsible for any problems with any telephone network or lines, computer online systems, servers or providers, software, failure of email on account of technical problems on the Internet, including injury or damage to my computer resulting from participating or downloading materials in connection with the Web and/or in connection with the Services.
12. LOSS. I AGREE THAT TRUE.COM WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE, INCLUDING PERSONAL INJURY OR DEATH, RESULTING FROM ANYONE'S USE OF THE WEB SITE OR THE SERVICES, ANY INFORMATION POSTED ON THE WEB SITE OR TRANSMITTED TO MEMBERS, OR ANY INTERACTIONS BETWEEN USERS OF THE WEB SITE, WHETHER ONLINE OR OFFLINE.
DISPUTES AND INDEMNIFICATION
13. Disputes. I AGREE THAT IF THERE IS ANY DISPUTE ABOUT OR INVOLVING THE WEB SITE AND/OR THE SERVICE, BY USING THE WEB SITE, THE DISPUTE WILL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO ITS CONFLICT OF LAW PROVISIONS. IF I AM NOT A RESIDENT OF THE STATE OF TEXAS, I AGREE TO PERSONAL JURISDICTION BY AND EXCLUSIVE VENUE IN THE STATE OF TEXAS AND THE U.S. DISTRICT COURT FOR THE NORTHERN DISTRICT OF TEXAS. IF I AM A RESIDENT OF THE STATE OF TEXAS, I AGREE TO PERSONAL JURISDICTION AND EXCLUSIVE VENUE IN THE STATE COURTS OF TEXAS.
14. INDEMNITY. I AGREE TO INDEMNIFY AND HOLD TRUE.COM, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, MANAGERS, AGENTS, AND EMPLOYEES HARMLESS FROM ANY LOSS, LIABILITY, CLAIM, OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF MY USE OF THE SERVICES IN VIOLATION OF THIS AGREEMENT AND/OR ANY BREACH OF MY REPRESENTATIONS IN THIS AGREEMENT.
MISCELLANEOUS
15. U.S. Export Controls. Software from this Web site (the "Software") is further subject to United States export controls. No Software may be downloaded from the Web site or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, or any other Country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
16. Advertisers. I acknowledge that my correspondence or business dealings with advertisers found on or through the Services, including payment and delivery of related goods or services are solely between myself and such advertiser. I agree that TRUE.com shall not be responsible or liable for any loss or damage incurred as the result of such advertisers on the Services.
17. Other. This Agreement contains the entire agreement between myself and TRUE.com regarding the use of the Web site and/or the Services. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
TERMINATION
18. Account Termination. I may terminate my account only by contacting TRUE.com Customer Service by phone between the hours of 7 a.m. and 10 p.m. (Central) Monday through Friday, and between the hours of 9 a.m. and 6 p.m. (Central) on Saturday and Sunday. In the United States and Canada, dial toll-free 1.866.583.TRUE (8783) or 1.972.374.9191 (toll charges apply). I agree that TRUE.com may terminate my account for any reason, effective upon sending notice to me at the email address I provided when signing up.
19. Fees. In the event I terminate my account or TRUE.com terminates my account, I agree that all fees then paid to TRUE are non-refundable.
20. CANCELLATION AND REFUNDS. I UNDERSTAND THAT CERTAIN STATES ALLOW ME TO CANCEL THIS AGREEMENT, WITHOUT ANY PENALTY OR OBLIGATION, AT ANY TIME PRIOR TO MIDNIGHT OF TRUE.COM'S THIRD BUSINESS DAY FOLLOWING THE DATE OF THIS AGREEMENT, EXCLUDING SUNDAYS AND HOLIDAYS. TO CANCEL, CALL A TRUE.COM CUSTOMER SERVICE REPRESENTATIVE DURING NORMAL BUSINESS HOURS AT 1.866.583.TRUE (8783) or 1.972.374.9191 (TOLL CHARGES APPLY). THIS SECTION APPLIES ONLY TO INDIVIDUALS RESIDING IN STATES WITH SUCH LAWS

I HAVE READ THIS AGREEMENT AND AGREE TO ALL OF THE PROVISIONS CONTAINED ABOVE. I AGREE TO THE CHARGES FOR THE SERVICES.
